What is a Party Wall Agreement?

A Party Wall Agreement which is also known as a Party Wall Award is a document produced by a party wall surveyor acting for the respective owners.

A Party Wall Award will typically consist of and contain three parts which are as follows:

  • It sets out the proposed work that will be carried out, how and when such work may be carried out, any rights of access and if any additional works are required.
  • A schedule of condition of the adjoining property with supporting photographs.
  • A method statement and/or details of the proposed works, including copies of drawings and plans etc

 

 

A Party Wall Award details the propert owners and the property addresses. along with details of the two surveyors (or one agreed surveyor) and a third surveyor if applicable.

Other items covered by an Award may include confirmation that the necessary public liability insurance is in place, any time limit for the work and the fees of the adjoining Party Wall Surveyor (if applicable).

A Party Wall Agreement / Award is always signed and witnessed by both parties. Copies are kept by both owners and an additional copy is passed on to the builder or contractor.

Under section 10 (17) of the Party Wall etc. Act 1996 either party may within 14 days appeal to the County Court if they feel that the award has been made improperly. This rarely happens but in the event that it does we can assist with such an application.
