HSBC have a mortgage product called an “indirect mortgage” whereby two (or more) people will be named on the legal title however one person will only be named on the mortgage.

As a result, HSBC will require the person who is not being named on the mortgage to obtain independent legal advice by a solicitor to ensure that they have the consequences of entering into such an arrangement explained to them. The solicitor will then have to witness their signature on the Indirect Mortgage Deed and sign a Certificate of Execution for HSBC confirming who provided the advice and on what date etc.
