Joint borrowers sole proprietor mortgages – Independent Legal Advice
HSBC, Barclays and Santander (and perhaps more lenders) have a mortgage product called an “indirect mortgage” whereby two (or more) people will be named on the legal title however one person will only be named on the mortgage, or more than one person will be named on the mortgage and less will be named on the legal title.
As a result, the lender will require the person who is not being named on the mortgage to obtain independent legal advice by a solicitor to ensure that they have the consequences of entering into such an arrangement explained to them. They may also ask the borrower who is not being named on the title to obtain independent legal advice. The solicitor will then have to provide advice, witness signature(s) on the Indirect Mortgage Deed and sign a Certificate of Execution for the lender confirming who provided the advice and on what date etc.
